Decree 13/2023/ND-CP of the Vietnamese government to protect personal data (mentioned source) went into effect on July 1, 2023, and it has an impact on a number of goods and services that Kompa Technology offers to clients.
Therefore, after conducting research, careful review as well as consulting and consulting from companies/units specializing in Law, we would like to respectfully inform our customers of our products. /service will be adjusted and changed to ensure legality after this Decree takes effect.
1. Consider the legality of the products/services Kompa is providing
Kompa’s social network public conversation analysis reports do not penetrate any individual’s database, and Kompa affirms that it does not buy or sell user data with companies/agencies. All analyzed conversations do not belong to and do not contain personal information of an identifiable subject.
Pursuant to Decree 13/2023/ND-CP:
Definition of personal data “Personal data is information in the form of symbols, letters, numbers, images, sounds or similar forms in the electronic environment that is associated with a specific person or helps identify and define a specific person.” (Clause 1, Article 2)
Definition of information that identifies a specific person “Information that helps identify a specific person is information formed from an individual’s activities that when combined with other stored data and information can identify and define a specific person.” (Clause 2, Article 2)
So according to these definitions, social network user conversation information is considered personal data only if and only when combined with other stored information that can identify a specific person such as name, phone number… Kompa does not perform database intrusion or purchase or sell any personal information in the products and services provided. The source database for Kompa’s analytical reports is a public source left by users on social networks, and these contents are not security verified by registered users with any authority, so they are not an available basis for verifying the accuracy of personal identification.
2.From July 1, 2023, Kompa will make the following changes to its goods and services to comply with Decree 13.
2.1. In accordance with Clause 3, Article 2 of Decree 13/2023/ND-CP, Kompa’s negative information warning emails and SMS sent to customers will not contain or be accompanied by information that can be used to identify a specific person, such as contact information (phone number, email, location), and demographic factors (gender, region, age, and nationality). To ensure legitimacy, this information will be encrypted, obscured, or concealed if it is present in the content.
2.2. Kompa also does not provide raw data collected from Social Networks but has information fields that can help identify an individual including contact information (phone number, email, location) and other factors Demographics (Gender, region, age, nationality) according to Clause 3, Article 2 of Decree 13/2023/ND-CP.
2.3. In accordance with Article 9 of Decree 13/2023/ND-CP’s Decree on the Rights of Data Subjects, Kompa’s reports when analyzing customer demographic factors will only be based on conversations and data research and are absolutely not based on information that helps identify any individual whether that be public data.
3. Time to apply changes:
Immediately after Kompa Technology sends this notice to customers.
Kompa Technology strictly complies with the provisions of the Law to ensure the legitimate rights and interests of customers as well as Kompa Technology itself, so we hope that customers will understand the changes in products/services being provided from Kompa Technology.
